I often advise my clients to consider several factors when making this selection. Firstly, think about who understands your wishes and values. Moreover, do they have the time and resources to devote to this responsibility? Remember, administering an estate can be complex and time-consuming. Conversely, if someone is already overwhelmed with their own commitments, they may not be the best fit.
Notwithstanding these considerations, it’s important to remember that you can always name a successor executor or trustee in case your first choice is unable or unwilling to serve. Ordinarily, I recommend discussing your decision with the potential executor or trustee beforehand to ensure they are comfortable taking on this role.
