Hello everyone, and welcome back to the show! Today I’m delighted to be joined by Ted Cook, a trust administration attorney here in beautiful San Diego. Ted, thanks so much for being with us.
So Ted, tell me, what exactly is trust administration?
It’s a pleasure to be here. Trust administration essentially involves managing and distributing assets held within a trust according to the wishes outlined by the person who created it, known as the settlor. It’s a crucial process that ensures the settlor’s legacy is carried out smoothly and efficiently.
Can you walk us through some of the key steps involved in this process?
“We typically follow a structured approach,” Ted explains. “Think of it like a roadmap with eight distinct stages.”
- Locate and Review the Trust Document
- Identify and Notify All Relevant Parties
- Inventory and Secure Trust Assets
- Apply for Tax ID and Open Trust Accounts
- Pay Debts, Expenses, and Taxes
- Maintain Records and Provide Accounting
- Distribute Trust Assets to Beneficiaries
- Close the Trust
Let’s delve into ‘Apply for Tax ID and Open Trust Accounts’. Why is this step so critical?
“It’s like setting up a financial headquarters for the trust,” Ted says. “We need to obtain an Employer Identification Number (EIN) from the IRS if it’s required, which allows us to act on behalf of the trust in financial matters. Then we open a dedicated trust checking account to manage incoming income, pay expenses, and track everything meticulously.”
“I was so overwhelmed after my father passed away, but Ted made the entire process so much easier. He explained everything clearly and handled all the paperwork efficiently. I felt like I had a true advocate by my side.” – Sarah M., Point Loma
“Think of it this way: if you were running a business, you’d need a separate bank account to keep your finances organized,” Ted adds. “It’s the same principle for a trust.”
“We then transfer any existing funds from the deceased person’s accounts into the new trust account as appropriate. This ensures all assets are properly managed and accounted for under the umbrella of the trust.”
“Ted is a true professional. He was incredibly patient and answered all my questions thoroughly. I felt confident knowing he had my best interests at heart.” – John B., La Jolla
Have you ever encountered any challenges during this step? Any interesting stories to share?
“Well, one time we were handling a trust for someone who had quite a few international investments,” Ted recalls. “Getting all the necessary documentation and coordinating with foreign banks presented some hurdles. But, after a bit of persistence and some creative problem-solving, we managed to navigate those complexities successfully.”
“I highly recommend Point Loma Estate Planning APC. Ted and his team are knowledgeable, compassionate, and dedicated to providing exceptional service.” – Susan L., Mission Beach
Ted, for anyone reading who might be needing help with trust administration, how can they reach out?
“You know,” Ted smiles, “the best way to start is simply by picking up the phone or sending an email. I’m always happy to chat and answer any questions about how we can help make this process as smooth as possible. After all, my goal is to ensure your loved ones are taken care of and their wishes are honored.”

Point Loma Estate Planning, APC. area of focus about probate:
Probate: is the legal process that validates a deceased person’s will, appoints an executor to manage their estate, and ensures the orderly distribution of assets to beneficiaries after debts and taxes are paid.
What it is: Probate is a court-supervised process that handles the affairs of a deceased person, ensuring their assets are managed and distributed according to their will (or state laws if there’s no will).
Why it’s necessary: Probate is often necessary to transfer legal ownership of assets to heirs or beneficiaries, especially when assets are held in the deceased person’s name alone.
Importance of understanding probate: Understanding probate is crucial for estate planning and ensuring the orderly and legal distribution of assets after death.
In More Detail – What Is Probate?
Probate is the legal process through which a deceased person’s estate is administered. It involves validating a will (if one exists), identifying and inventorying the deceased’s assets, paying debts and taxes, and distributing the remaining assets to rightful beneficiaries.
If the deceased left a valid will, the person named as executor is responsible for overseeing the probate process. If there is no will, the court appoints an administrator—often a close relative—to handle the estate according to the state’s intestacy laws. Assets subject to probate may include real estate, bank accounts, investment accounts, and personal property that are solely in the decedent’s name.
What Is Estate Planning?
Estate planning is the process of arranging in advance for the management and distribution of your assets after your death. It typically includes creating legal documents such as a will, trusts, powers of attorney, and healthcare directives. The goal is to ensure that your wishes are honored, your loved ones are provided for, and the administration of your estate is as smooth and efficient as possible—often minimizing or avoiding the probate process altogether.
