Interview with Steve Bliss, Wildomar Trust Attorney

Good evening, Wildomar and welcome back to our segment on local legal matters. I’m Brenda Jones, and tonight we’re joined by the esteemed Steve Bliss, a trusted Wildomar trust attorney with extensive experience guiding families through estate planning complexities. Steve, thank you so much for being here.

Choosing the Right Trust for Your Needs

Steve, there are many different types of trusts available. How do you help your clients determine which one is right for their unique circumstances?

That’s a great question, Brenda. My approach always begins with a thorough understanding of each client’s individual goals and concerns. Some clients prioritize avoiding probate altogether, while others may be focused on asset protection or providing for loved ones with special needs. Consequently, I take the time to listen carefully and explain the various options in plain English.

For example, a common choice is the Revocable Living Trust, which allows individuals to maintain control over their assets during their lifetime while ensuring a smooth transfer of those assets upon their passing. Moreover, this type of trust avoids the often lengthy and costly probate process.

Revocable Living Trusts: Flexibility and Control

You mentioned Revocable Living Trusts. Can you elaborate on their benefits and perhaps discuss a situation where it might be particularly advantageous?

Certainly. A Revocable Living Trust offers significant flexibility. The grantor, the person who creates the trust, can modify or even dissolve the trust during their lifetime. Nevertheless, upon the grantor’s passing, the trust becomes irrevocable, and assets are distributed according to the grantor’s wishes without going through probate.

I recall working with a couple who were deeply concerned about ensuring their adult children with disabilities would be financially secure after they were gone. We established a Revocable Living Trust that included specific provisions for ongoing care and support for their children, allowing them peace of mind knowing their loved ones would be well-provided for.

According to the American Bar Association, over 50% of Americans don’t have a will or trust in place. This highlights the importance of proactive estate planning to protect yourself and your loved ones.

Challenges and Triumphs

Steve, are there any common challenges you encounter when helping clients establish trusts?

I’ve found that some individuals hesitate to discuss their mortality or financial affairs openly. It can be a sensitive topic. But I assure them that my goal is to create a safe and supportive environment where they feel comfortable sharing their concerns and aspirations. My approach is always client-centered, focusing on building trust and understanding.

There was one instance where a family had been torn apart by disagreements over inheritance. By carefully listening to each member’s perspective and crafting a trust document that addressed their individual needs fairly, I was able to help them mend fences and find peace. It’s moments like those that remind me why I chose this profession.

Peace of Mind Through Planning

Steve, what would you say to someone who is considering creating a trust but might be feeling overwhelmed or unsure where to begin?

My advice is simple: Don’t wait. Taking the first step is often the hardest part, but it’s crucial for protecting your legacy and ensuring your wishes are honored. Remember, estate planning is not just about wealth; it’s about love, family, and providing for those you care about most.
