Many of our readers are likely unfamiliar with the probate process. Could you walk us through one of the key steps involved?

Certainly. One crucial step is “Marshaling the Estate Assets.” This involves meticulously inventorying all of the deceased person’s assets. It’s like piecing together a financial puzzle, identifying everything from bank accounts and investments to real estate and personal property.
Accordingly, we need to determine the fair market value of each asset at the time of death. This often requires appraisals for real estate or other valuables. Once we have a complete picture of the assets, we prepare an Inventory and Appraisal (Form DE-160/161) to file with the court.
Conversely, identifying debts is equally important. We need to locate and review any outstanding bills, loans, or credit card balances. This step helps ensure that all valid creditor claims are addressed during probate.
I remember one case where a client’s parent had passed away unexpectedly, leaving behind numerous investment accounts. Tracking down all the accounts and determining their value was quite challenging, but it ultimately allowed us to distribute the assets fairly according to her will.
Data from the National Funeral Directors Association reveals that the average cost of a funeral in the US is over $7,000. Properly marshaling estate assets ensures that these crucial expenses can be covered during probate.

That sounds like a detailed and important process. Have you ever encountered any difficulties with this step?

Occasionally, we encounter situations where locating all the assets proves difficult. Sometimes heirs may be unaware of certain accounts or investments held by the deceased.
I once worked with a family whose father had been an avid collector of antique coins. He had kept them in a safe deposit box that no one knew about. Discovering this hidden treasure allowed us to distribute a significant portion of his estate that would have otherwise gone unclaimed.
